Policy on Handling of Personal Information
S&W International Law Offices (henceforth "these offices") have established the privacy policy below and will strive to handle personal information appropriately, in addition to adhering to laws on the protection of personal information (henceforth "the Act on Protection of Personal Information") and other relevant legal statutes.
  1. Obtaining Personal Information

    • These offices obtain personal information in a legal and appropriate manner, limited to the scope necessary for completion of the intended purpose of said personal information.
  2. Use of Personal Information Outside of Its Intended Purpose

    • These offices use personal information in association with the provision of services by these offices, hiring of attorneys, employees, etc., and performance and administrative management. Said uses fall within the scope necessary for completion of the following purposes.

    1. Processing of cases and contact associated with processing of cases
    2. The provision of information concerning guidance on these offices, lectures, seminars, etc., sending of greeting letters, and other legal services provided by these offices.

    4. Other uses enabling the smooth and appropriate execution of these offices' duties.
    Hiring of Attorney, Employees, Etc.
    1. Personal information obtained pertaining to hiring of attorneys
    - For the execution of a welcome during office visits, business contact, and screening procedures, and for hiring decisions.
    - Personnel management and training after hiring

    - For the execution of business contact and screening procedures, and for hiring decisions.

    Administrative and Performance Management of Attorneys and Employees
    1. Execution of procedures including the creation of registers required for business, business communication, procedures related to employee benefits, procedures related to social insurance, and all other procedures required by laws and ordinances.
    2. Determination and payment of salary and all other types of compensation, execution of tax withholding processing.
    3. Personnel assessment, determination of compensation raises/reductions, personnel transfers, and selection of personnel placements.
    4. Execution of education and training, health management, and implementation of all other office policies.
    5. All other appropriate forms of personnel/labor management regarding these offices.
  3. Use of Personal Information Outside of Its Intended Purpose

    • These offices use personal information only for the purposes listed above, and excluding cases permissible by law or in which notice or public notice of another intended purpose is provided, personal information is not used for other purposes without the consent of the individual.
  4. Provision of Personal Information to a Third Party – Shared Use

    • These offices will not provide personal information to a third party without the consent of the individual in question, except in the event that it is permissible by law and that these offices share personal information with S&W International Co., Ltd. (HQ: Arute-Higobashi-Bldg. 6F, 1-15-27, Edobori, Nishi-ku, Osaka. Same henceforth.) as electronic data (excluding cases in which the individual in question requests a halt to provision of individually-identifying personal data to third parties) for consigned business processes including sending of invoices, etc.
    These offices engage in shared use of personal data as detailed below, within the scope required to achieve the intended purpose. Personal data for shared use is provided to the users detailed below.

    - Intended purpose of shared use: intended purposes for personal information detailed above

  5. Implementation of Safety Management Measures for Personal Information

    • To prevent events such as the leaking, destruction, or loss of personal information, these offices will implement necessary and adequate measures to manage personal information appropriately. Furthermore, this office will supervise consignees for appropriate handling of personal information in the event that it is consigned, and will conduct appropriate supervision of employee handling of personal information.
  6. Requests for Disclosure, Revision, or Cessation of Use of Personal Information

    • In the event that these offices receive a request from the individual in question for disclosure, revision/addition/deletion, cessation/elimination of use, cessation of provision to third parties, or notification of intended purpose based on the Act on Protection of Personal Information and regarding personal information these offices hold, these offices will confirm the identity of the individual placing the request and respond in accordance with the provisions of the Act on Protection of Personal Information.   8. Changes To This Privacy Policy

    • These offices may revise this privacy policy as required.
    Client Identity Confirmation
    The Japan Federation of Bar Associations' "Rules concerning identity confirmation of clients and record keeping" went into effect on July 1st, 2007. As per the terms of these rules, these offices may confirm potential client identity upon accepting a set level of new work, upon accepting a retainer against work, as well as in other cases. Your understanding and cooperation is appreciated.
    Administrative and Performance Management of Attorneys and Employees
    - Individuals
    Confirmation via submission of official documents bearing the individual's name/address/date of birth (i.e. driver’s license, passport, health insurance card, pension book, alien registration card).
    - Legal Entities
    1. Confirmation via submission of registered certificate of legal entity name and headquarters or primary office, and
    2. Confirmation of the name and position of the corporation’s representative or agent, etc. (i.e. confirmation via business card, etc.).
